Our legislation

The Emergency Management Act 2013 (the Act) establishes Emergency Management Victoria (EMV) which consists of:

  • The Emergency Management Commissioner (EMC) who is responsible for coordinating the response to major emergencies (including ensuring appropriate control arrangements are in place) and operating effectively during Class 1 and Class 2 emergencies.  The EMC is also responsible for co-ordinating consequence management and recovery for all major emergencies.
  • The Chief Executive of Emergency Management Victoria who is responsible for the day to day management of Emergency Management Victoria, and the coordination of investment planning for large scale strategic projects for the responder agencies including major procurement and communications and information systems

The Act also:

  • Establishes the State Crisis and Resilience Council; which is responsible for providing emergency management policy and strategy advice to the Victorian Government. Its membership consists of the secretaries of all Government Departments, the Chief Executive Officer of the Municipal Association of Victoria, the EMC, the Chief Executive of EMV and the Chief Commissioner of Victoria Police.
  • Establishes the Inspector-General for Emergency Management; whose functions include developing and maintaining a monitoring and assurance framework, and evaluating the performance of the sector.
  • Provides for the development of: the State Emergency Response Plan and the State Emergency Recovery Plan.

The 2013 Act operates concurrently with the Emergency Management Act 1986 with the intention that the 1986 Act will ultimately be repealed.
